After months of negotiation between the House and Senate, Governor Mike DeWine signed HB 29 into law on December 8, 2021. The bill established January 1, 2023 as a universal launch date for all operators — a "shotgun start" designed to level the playing field.

The law created three license types: Type A (25 licenses for mobile/online, each allowing two operator skins), Type B (40 licenses for retail sportsbooks, allocated by county population), and Type C (kiosks at bars, restaurants, and lottery retailers). The Ohio Casino Control Commission oversees licensing and enforcement for Types A and B, while the Ohio Lottery Commission administers Type C kiosks in partnership with the OCCC.

The original tax rate was set at 10% of gross revenue. However, DeWine pushed to double it to 20% in his first budget after launch, effective July 1, 2023. He attempted to double it again to 40% in February 2025, but Ohio lawmakers removed the proposed increase from the 2026-27 budget in June 2025. The 20% rate remains in effect. Ohio also became a national leader in college betting restrictions when the OCCC banned individual college athlete prop bets effective March 1, 2024. Governor DeWine has since pushed for a broader ban on all player prop bets, including professional sports, though no regulatory action has been taken as of February 2026.

Ohio Sports Betting Licenses
