New York Sports Betting Legislation

New York's path to legalized sports wagering actually happened in two key stages:

Stage 1 — Retail Sports Betting: Retail sports betting at the state's commercial casinos was authorized as part of the Upstate New York Gaming Economic Development Act of 2013. This laid the groundwork by including a provision that allowed the state's licensed casinos to offer sports wagering if federal law ever permitted it. After the U.S. Supreme Court struck down the federal ban (PASPA) in May 2018, New York's upstate casinos were able to open retail sportsbooks, with the first ones launching in July 2019.

Stage 2 — Mobile/Online Sports Betting:  The bigger and more consequential step was the legalization of mobile sports wagering, which was tucked into New York's Fiscal Year 2022 State Budget Bill — S2509-C / A3009-C, signed into law by Governor Andrew Cuomo on April 19, 2021 (Chapter 59 of the Laws of 2021, Part Y). This is the legislation most people refer to when discussing NY's sports betting legalization.

New York Sports Betting Licenses

New York has issued nine online sports wagering licenses, all awarded through a competitive Request for Applications (RFA) process conducted by the Gaming Commission in late 2021. 

Online operators are required to partner with one of the state's licensed commercial casino facilities, and the Commission retains authority to approve or deny all sports and league markets available for wagering. 

License types include mobile sports wagering operators, retail/facility licensees, and platform providers. There is no guaranteed pathway for additional operators to enter the market beyond the original nine licenses — expansion would require either a new RFA or legislative action. A bill introduced in January 2026 would expand the eligible operator count, but no legislation had passed as of this writing.

Illegal Sportsbooks in New York

Despite New York's robust legal market, offshore and unlicensed operators continue to target Empire State bettors. These platforms operate outside New York law and carry no consumer protections — if a site refuses to pay out winnings or mishandles your data, there is no recourse through New York regulators. The New York State Gaming Commission and the Attorney General's office have both issued public warnings about unlicensed betting platforms, including prediction market operators. Sports betting in New York is regulated by the New York State Gaming Commission, the state's primary gambling regulatory authority. New York Sports Betting Taxes

As of early 2026, no legislative change to the rate was imminent.

For Bettors: All gambling winnings are taxable income in New York at both the state and federal levels. New York State imposes a graduated income tax on all gambling winnings, with the state withholding rate determined by the size of each payout. Federal income tax is assessed at 24% standard withholding on winnings above $600. Bettors may deduct documented gambling losses from their reported winnings when itemizing deductions, but losses cannot exceed reported winnings. New York bettors should maintain records of all wagers placed.
